Terms & Conditions
1. Acceptance
These Terms & Conditions (“Terms”) govern the use of the CLAP platform (“Connect Like a Professional”), available at clapanimation.com (the “Service”), operated by Lorenzo Franco (a natural person), in Bogotá, Colombia. By accessing or using the Service, you confirm that you have read and accepted these Terms, the Privacy Policy, and the Cookie Policy. If you disagree, do not use the Service.
2. What CLAP is
CLAP is a directory and search engine for the animation industry in Latin America: artists, companies and studios, schools, jobs, events, and contests/festivals. Some content is built from public information (see the Privacy Policy) and some is contributed by users.
3. Changes to the Service and these Terms
We may add, modify, or remove Service features, and update these Terms, at any time. Changes take effect when published on this page. Continued use of the Service after publication means you accept the changes.
4. Registration and account
- To claim or manage a profile you must sign in (currently with Google) and have the legal capacity to contract.
- The Service is intended for people 18 and older; minors need verifiable authorization from a legal guardian.
- You agree to provide truthful, up-to-date information. We may verify it and suspend or cancel accounts with false information.
- You are responsible for activity carried out from your account.
5. Public profiles, claiming, and removal
- Directory profiles may be created from public information and are publicly visible to fulfill the Service’s purpose.
- Any person who is the subject of a profile can claim it to manage it, or request its removal from the profile itself. We handle these requests per the Privacy Policy.
6. Content you provide
- License. By posting content (text, links, images, job/event/award posts, suggestions), you grant CLAP a non-exclusive, worldwide license to host, display, and distribute that content within the Service. You retain ownership of your content.
- Responsibility. You represent that you hold the necessary rights to the content you provide and that any third-party information is public or authorized.
- Résumé (CV). Your CV is not published openly or shared with third parties without your consent, except as necessary to operate the Service.
- You must not post unlawful, defamatory, offensive, misleading, or rights-infringing content. We may review, edit, or hide content that breaches these Terms.
7. User conduct
You agree not to:
- Damage, overload, or interfere with the Service or its security.
- Use robots, scrapers, or other automated means to copy the Service without authorization.
- Impersonate others or create false identities.
- Send spam or collect other users’ data without their consent.
- Attempt unauthorized access to restricted areas of the Service.
8. Intellectual property
The Service, its software, design, trademarks, and other elements are owned by CLAP or its licensors and protected by law. You are granted a limited, non-exclusive, non-transferable right to access and use the Service for your personal or professional use, without transfer of ownership. Third-party trademarks and logos belong to their respective owners.
9. Third-party content and links
The Service may display third-party content and links to external sites we do not control. We are not responsible for their content, accuracy, availability, or practices. Accessing external sites is at your own risk.
10. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind. We do not warrant that information is complete or accurate, or that the Service will operate without interruptions or errors.
11. Limitation of liability
To the extent permitted by law, CLAP is not liable for indirect, incidental, or consequential damages, or for lost profits, data loss, or interruption, arising from the use or inability to use the Service, transactions with third parties, or unauthorized access to your information.
12. Indemnity
You agree to hold CLAP harmless against claims, losses, and expenses (including attorneys’ fees) arising from your use of the Service, the content you provide, your breach of these Terms, or your infringement of third-party rights.
13. Termination
We may suspend or cancel your access to the Service if you breach these Terms or if your use is harmful to the Service or third parties. You may stop using the Service at any time.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Colombia. Any dispute will first be addressed directly and amicably. If no agreement is reached within ten (10) business days of the first written communication, the dispute will be submitted to an Arbitration Tribunal of the Arbitration Center of the Bogotá Chamber of Commerce, under its rules, seated in Bogotá and deciding in law.
15. General provisions
- If any clause is invalid, the rest remain in force.
- These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and CLAP regarding the Service.
